It seems like you're the media wing of the insurance industry…supporting its propaganda and false narrative of attorney-created lawsuits.
So all of these hurricane lawsuits are fraudulent, huh?…Even after being struck my multiple Cat4/5 hurricanes?
While filing 1600 lawsuits right before the statute of limitations deadline is not a smart way to practice law and draws unnecessary attention, not ALL attorneys practice law in this careless manner — I don't.
Unfair generalizations like these hurt our profession and hurricane victim rights, and do not provide any realistic solutions to insurance industry-wide bad faith problems, which include denying claims en masse.
Media pieces the these — which publicize isolated instances of poor attorney conduct while largely ignoring the insurance industry's bad faith business practices as a whole — actually create the perfect environment to pass laws that HURT hurricane victims and homeowners…like getting rid of the Florida one-way attorney fee statute so folks can no longer afford to hire legal counsel and sue insurance companies after their claims are denied.
And please don't twist the facts any further…Denial is the name of the game for the insurance industry — In fact, they denied coverage at an unbelievable rate of 30-40% for Cat 4 Hurricanes Ian and Michael claims. Also, over 65,000 Hurricane Ian claims to date have already been closed WITHOUT payment. If this ridiculous bad faith conduct by the insurance industry continues, expect more lawsuits protecting homeowners.
If carriers will do the right thing the first time then a lot of these lawsuits will be avoided. So Clearly the Mindset of the Insurance Carriers is to pay below deductibles or nothing ,at least 90% of them. It’s not a conspiracy, it’s risk management telling them how to play the process. But Homeowners are getting more educated with insurance claim processing and are fighting back the carriers and that in return is allowing more Attorneys to represent your normal middle class who has Been getting screwed up and down and left and right for a very long time.
Thoughts: Fee: no one is required to hire this firm. Who cares about what they charge. Don’t like it, hire the next firm.
1600 filings: irrelevant. It’s their “reputation” he feels is on the line. But that’s all and if they don’t mind risking it, why the story time? 1600 tho, its irrelevant how many filings.

Regardless what they do here, they will never be senators regardless as they aren’t playing kiss azz game I’m sure worried about getting nominated by the President for a position. They know already that isn’t happening, carriers have too many ppl willing to “play ball” with them they rather push for nominees. This federal judge made his living trying to make everyone happy and like all Federal judges, utterly suck up to powerful corporations. Maybe that’s not for everyone.
It is obvious this judge is upset at the amount of work they have received. And that’s unprofessional in my opinion. He acts like he didn’t run campaigns talking trash about rival nominees. Wth is the diff in posting on Facebook?? It’s marketing.
Let’s be realistic. If you had 10,000 projects going on this year, do you really think 1600 is a large number? Did anyone check how many employees this firm has and check that against how many filings most firms do?
The best way to see how this all really is, check back in 1 year and see how many received nothing and how many got paid. That will tell us if it was bs or not.
I enjoy it because as a very small company compared to this Mosley outfit, I get railroaded constantly by the carrier. I see property owners give up way before trying to fight.
I do agree with your statement, the issues in Florida rest on many shoulders but I will always believe that domino push started with the fact the carriers require too large of a profit margin themselves. One state where they can’t “clean house” and control, making their billions and the run away. Keep in mind, insurance was founded on the idea and basis of being not for profit. There’s a reason so many carriers are changing policies constantly (people are being more educated) and more policy holders are hiring PA’s and attorneys (they get fed up having some carrier make it so difficult to get coverage they paid for for 30 years and filed zero claims)
I’ve had the luxury of seeing many of these exact claims, the carrier legit says umm we aren’t paying guess you will just have to file suit. I have had this happen multiple times in just the last year over tornado claims. Then they see us in appraisal and tell us they don’t agree with the appraisal and aren’t paying.
Moseley can say good things about judge but we all know everything he went on a rant about, purely irrelevant.

The Judge is wrong…WE THE PEOPLE in the USA, have a Fundamental Right to file grievances…if legit, so be it, 1 or 1,600 at a time.
Judge just doesn't want to do his job, but probably go play golf with Trump (appointed by him) instead!
We have the same problem here in Florida. Attorneys on both sides fighting for more and more of the proverbial pie… Insurance / Roofing are going to be very hot topics in this next Florida Legislative Special Session this December. A big part of the problem is crappy roofing materials and unsustainable practices using weaker asphalt underlayments and asphalt shingles. Roofers everywhere are adopting synthetic polypropylene underlayments to counter increasing extreme weather events while creating value to their customers by increasing resiliency and longer life cycles.
One particular Texas PA who was tight with this law firm had his license revoked by TDI recently. I testified against him during his hearing.

What makes you think insurance companies short their claims 30-40% on average? I’ve handled thousands of property claims for multiple insurance companies and we have never intentionally shorted a claim, even by $1. Our goal is to pay the proper amount owed and not a penny more or less. Of course the coverage purchased by the policyholder dictates the settlement.

On the surface, it sounds like the cases could be better presented as a class action suit. Since most insurance is regulated at the state level, a logical question is why is this at the federal level? It would help to have the case file number, so we could follow it better.
Went to WTS in 2020 and saw they got attorney of the year award. I decided to give them a try on a large loss claim in Iowa, Worst decision ever. These guys are slime balls and only care about money. They don’t care about the policyholders or the contractors that hired them. They even had the audacity to cut me out of the commercial supplements I was doing for a company after I’m the one that brought them in. Worst lawyer ever and his partner Pate is just as scummy.. 10/10 Do NOT recommend these unscrupulous untrustworthy law firm.
How much they’re charging? First party attorneys fees or contingency fees. Some do hourly. Even Public Adjusters are limited to 10% for one year under Florida law for one year after the Hurricane ( named storm).
