The fact that the bar could get in trouble because of an irresponsible customer is honestly so unfair. That’s like working at Home Depot and ringing someone up for an axe and then they kill someone with that axe, resulting in YOU getting sued by the deceased person’s family for selling the murderer the weapon.
You can talk about how you robbed a bank yesterday and shot 3 people in the chest with a 12 gauge shotgun and the bartender wouldn't tell anyone
What kind of dumb law is that? If someone is irresponsible enough to drink till drunk then ask for more then hurt themselves how is that the bartender's fault?

Oh, on a very serious tip, we just lost five people in just this way. Wiped out five family members.
I hope this serves as a lesson YET AGAIN, to not let drunk people drink and drive ANYWHERE.

That makes absolutely no sense it was not the bar that interest you to drive drunk that was the person who chose to get drunk and then start driving the bar has nothing to do with it

I wish more bartenders would stand up for this. Too many times I see them leave the person be.
My dads life was pretty much ruined over these laws for 2 years while we waited on court. His bartender served a man 9 beers over an 7 hour time span, in between beers he would go outside & take shots off a bottle he had in his car. Left our restaurant & as he pulled out onto the highway he hit a mother who was out walking with her kids. She was paralyzed & her oldest child was beyond traumatized, after he hit her he took off & crashed/ditched the car about 3 miles down the road. She went after my dads business for “over serving” the man who hit her but thankfully we had cameras & the guy was on video taking pulls off of the bottle every 15-20 minutes over the 6 hours he was there. It’s easy to say that we should have known he was drunk but he had been eating all day while drinking & was really good at being able to hide how drunk he was.
WTF this is a horrible law?
They don't only sue the bar. The order goes like this -> Bartender, Bar Manager/General Manager, and Owner if they can prove all of these individuals played a part by either actively participating in the event or creating an environment for the event to occur.
I was a Food and Beverage serve at a Casino, and was forced to learn Dram Shop low front-to-back. Please don't come to me for legal advice.

This is true for retail sales of alcohol in some places. I was told when being trained for beer and wine sales that if I sold alcohol to someone underage who was then in an accident while drunk (or to someone who was already visibly drunk, etc), I could be held responsible to some degree just as the person who sold someone underage alcohol.
There is a reason why as a bartender, you can cut some off from drinking.
You can literally sue for anything in America it’s crazy

They teach us this in culinary school. But when I moved to Las Vegas the law is lil different.
I have a tobacco and liquor licence. I know all about the dram law. Not only could a person sue the bar, but the bartender as well. Not only will you have to pay whatever you are sued for, but fines from the state and possibly have license suspended or taken permernt.
With all these ambulance chasers around and ever rising taxes and regulations, you'd be a fool to even want to operate a business like a bar.

And she got blamed for it

I can see if the guy is Falling down pissy drunk now No one should be held responsible for somebody else's action he drove the car he hurt the people he should be reliable

My grandparents owned a winery and some ladies shortly after they left got in an accident and tried to sue them. They showed through security cameras that they weren't served and that they only bought bottles then went to another winery where they were served then got in the accident

This is like saying gun manufacturers are at fault as well if a gun owner kills someone
I don't understand how bartenders can Guage how drunk someone is. For example. I know someone who can get 6 beers in, be very drunk and can hold a coherent conversation, not slur and could easily pass as sober. But the moment he drives, he's incapable of driving properly.
So how does one exactly know a cutoff limit?
Stupid law. Every drinker should know their limits.

So my local bar has a test were they ask you to count forwards to 20 out loud and count backwards from 10 on your hands at the same time. Usually they either stop counting out loud after hitting 10 or will keep counting with fingers past 10 if they are drunk.
