Medical law experts: Michigan Prop 3 unrelated to child consent laws, gender-affirming care



There have been a lot of claims on both sides about what the impact of Proposal 3 would mean if it were to pass. Proposal 3, at its core, would enshrine access to abortion and reproductive health care into the state constitution. That means Michiganders would be afforded the same rights that were outlined in the1973 Supreme Court ruling in Roe v. Wade, which was overturned this year.

Really? Prop 3 is an Amendment to the Michigan Constitution, not just another law. It says what it says.

On the ballot: "This proposed constitutional amendment would: (first bullet point): Establish new individual right to reproductive freedom, including right to make and carry out all decisions about pregnancy, such as prenatal care, childbirth, postpartum care, contraception, sterilization, abortion, miscarriage management, and infertility;" ('individual' doesn't mean adult women only – females and males of any age are all 'individuals')

And (last Bullet point): "Invalidate state laws conflicting with this amendment." ('parental consent' laws and perhaps even others are invalidated)
